Consumer Terms and Conditions of Sale of goods and services purchased from ATOM VOIP Telephony. ATOM VOIP Telephony is the web shop trading division of ATOM Partners LimitedPLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE PLACING AN ORDER. YOU MAY WISH TO RETAIN A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE

1. Format of the Contract
  • 1.1 These terms of sale apply to all goods supplied by ATOM VOIP.
  • 1.2 No contract exists between you and ATOM VOIP for the sale of any goods until ATOM VOIP has received and accepted your order and has received payment in full (in cleared funds). Once ATOM VOIP does so, there is a binding legal contract between us.
  • 1.3 By way of clarification, an acknowledgement of your order will be sent to you via e-mail when you place your order.
  • 1.4 ATOM VOIP may change these terms of sale without notice to you in relation to future sales.
2. Description and price of the goods
  • 2.1 The description and price of the goods you order will be as shown on ATOM VOIP's website at the time you place your order. 2.2 The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, ATOM VOIP will inform you as soon as possible and notify you of the expected delivery date.
  • 2.3 Every effort is made to ensure that prices shown on ATOM VOIP's website are accurate at the time you place your order. If an error is found, ATOM VOIP will inform you as soon as possible and offer you the option of reconfirming your order at the correct price, or cancelling your order.
  • 2.4 In addition to the item price, you will need to pay a delivery charge for the goods.
3. Payment and Shipping
  • 3.1 Payment for the goods and delivery charges can be made by any method shown on ATOM VOIP's website at the time you place your order. Certain types of payment may incur additional charges, these will be indicated at the time of purchase. Payment is due before the delivery date.
  • 3.2 There will be no delivery until cleared funds are received.
  • 3.3 ATOM VOIP only ship to addresses within the UK. Shipping costs are calculated based on weight and destination, the shipping cost for your particular order can be seen on the first screen of the checkout process.
4. Delivery
  • 4.1 The goods you order will be delivered to the address you give when you place your order, delivery can only be made to addresses within the UK .
  • 4.2 Orders placed before 3.30 pm on a working day will be processed that day and will be delivered as per the requested delivery option, provided that no additional security checks are required and that all items are available in stock. A working day is any day other than weekends and bank or other public holidays.
  • 4.3 If delivery cannot be made to your address for reasons under ATOM VOIP's control ATOM VOIP will inform you as soon as possible.
  • 4.4 Every effort will be made to deliver the goods as soon as possible after your order has been accepted. However, ATOM VOIP will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In this case, ATOM VOIP will inform you as soon as possible.
  • 4.5 Time for delivery shall not be of the essence. The goods may be delivered by ATOM VOIP in advance of the quoted delivery date.
  • 4.6 Upon receipt of your order you will be asked to sign for the goods received in good condition. If you are unsatisfied with the condition the good are received in, the item should either be refused or details marked on the transporters copy of the delivery note along with your signature as a form of evidence. Failure to do so may affect any warranty claims that you make thereafter.
5. Risk/Title
  • 5.1 The goods are at your risk from the time of delivery.
  • 5.2 Ownership of the goods shall not pass to you until ATOM VOIP has received in full (in cash or cleared funds) all sums due to it in respect of the goods, and all other sums which are or which become due to ATOM VOIP from you on any account.
6. Your Right Of Cancellation
  • 6.1 You have the right to cancel the contract at any time up to the end of 7 working days after delivery of the goods.
  • 6.2 Written notice must be given to ATOM VOIP by letter, fax or e-mail, at the fax number or e-mail address shown below, giving details of the goods ordered. Notification by phone is not sufficient.
  • 6.3 If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to ATOM VOIP at your own cost. The goods must be returned to the address shown below. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit. The goods must not have been used, they must include all items despatched to you, and must be in pristine condition in their original packaging with no markings.
  • 6.4 Do not destroy, deface or obscure any identifying mark or packaging on or relating to the goods; maintain the goods in satisfactory condition and keep them insured on ATOM VOIP's behalf for their full price against all risks to the reasonable satisfaction of ATOM VOIP.
  • 6.5 If you do not return the goods as required, ATOM VOIP may charge you a sum not exceeding the direct costs of supplying and recovering the goods.
7. Warranty
  • 7.1 All goods supplied by ATOM VOIP are placed under warranty for 12 months from the date of supply (unless otherwise stated). This warranty does not affect your statutory rights as a consumer.
  • 7.2 This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by ATOM VOIP, failure to follow ATOM VOIP's instructions, or any alteration or repair carried out without ATOM VOIP's approval.
  • 7.3 If the goods supplied to you are damaged on delivery, you should notify ATOM VOIP in writing via letter, e-mail address or fax number shown below within 7 days.
  • 7.4 If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods, you should notify ATOM VOIP in writing via the e-mail address or fax number shown below, as soon as possible, but in any event within 7 days of the date you discovered or ought to have discovered the damage, defect or complaint.
  • 7.5 Please refer to the returns procedure for instructions as to how to return goods.

Returns Procedure
  • You must contact ATOM VOIP for authorisation before returning any goods. No goods will be accepted for return unless you have been issued with a Return Merchandise Authorisation (RMA) from ATOM VOIP.
  • The first stage in the process is to contact ATOM VOIP by email or fax with an outline of the problem.
  • One of our technical support staff will advise you by email or fax of some simple steps to rectify the problem.
  • If you still have difficulties, then a technical expert will speak to you to try to resolve the issues, if the expert judges that the equipment is a fault then a RMA will be issued for you to return the goods.

    ATOM VOIP Conditions for Processing Returns
  • ATOM VOIP will only accept products that are in a "Returnable Condition". Products must be returned to us with all items included in the original sale including manuals, cables, disks and any free software items. Any goods returned for credit or replacement must be in original product packaging in a suitable condition- no writing or stickers on the manufacturers box and packed securely inside an outer box. In all cases an RMA number must be included with the parcel.
  • Where ATOM VOIP arranges collection of goods, it is still the responsibility of the customer to ensure that the goods are securely packaged and with the destination address clearly labelled on the outside of the outer box.
  • Returned products must be adequately wrapped to prevent damage during transit with the RMA number or end user details clearly marked on the outside of the package. It would help us to speedily process your return if you also enclosed a detailed note of the fault.
  • ATOM VOIP does not accept liability for packages damaged during transit and proof of postage is not proof of delivery. All good returned remain your responsibility until signed for by ourselves. You are therefore strongly advised to send your package by recorded delivery, registered post or courier and maintain sufficient insurance to cover the value of the goods. The cost of return carriage is to be borne by the end user, unless being returned under the terms of a Dead-On-Arrival unit.
  • On receipt of the package, the product will be tested against the stated fault (if any). Tested products found to be in full working order will be returned to the end user. ATOM VOIP reserve the right to charge 50% of the equipment cost for testing and handling.
  • Please note: Your right to cancel does not extend to business customers or goods that are collected from ATOM VOIP. You have the right to return goods collected from us within 14 days, returns are subject to a 15% handling charge. With the exception of faulty items, which are subject to a full refund or exchange.
  • For products beyond the 12 month warranty period, ATOM VOIP may accept faulty units for repair but the full cost of repairs, handling and postage is to be the service provider/end users responsibility.
  • Refunds will not be given for goods that are not faulty or where the operator is not able to use the product properly - you are expected to ensure that the product is suitable before purchase and that you have the skills to install and use the product.
  • Where a product is out of warranty, then we may choose to offer a repair service.
  • This warranty does not apply to any unit that has been subject to neglect, accident, abuse, misuse, misapplication, incorrect connection or that has been subject to repair or alteration not authorised or undertaken by ATOM VOIP personnel.
  • Any refund or replacement is entirely at the discretion of ATOM VOIP. If you would like to request a return, use the contact us page.
